Other threads are referring to some sisters having post nups in place. I have the process started, but it’s dragging on. Partly (mostly?) because of my irrational fear it will actually blow up my strategy.
Can anyone share what, how, what state you’re in, any details about how it would be triggered.
For example, my attorney said best to divide property and assets now. But Recent visit to accountant explains serious tax consequences for doing that. So she’s putting stuff in the doc and telling me that it has to pass muster for a judge to even consider it, but I am still no further along into the process, and attorney has charged me a lot of money for stuff that can’t even be done.
I’m tearing my hair out. She’s a mediator type of lawyer, should I get an attack dog? She’s warned me about not using this document to manipulate then like invoke it right away to get a better financial picture. She seems more suspicious of me that of him.
As some may have read, I gotta stay here, but he promised to put his money where is mouth (dick?) is. From telling me he’ll live in a hovel to make this up to me, now he’s got the wording, I’ll do everything I can?

I don’t have a post nup (already divorced) however in my state they are not given any merit per my divorce attny who’s been practicing for 25 years. Pre nups are held to but not post nups in my state. It may very state to state??? IDK.November 27, 2013 at 6:09 pm #118165972MemberI have one and my attorney never called it a “post nup” per say. He drew a a bunch of papers that he thought a judge would deem okay. I would absolutely be liable for taxes if I drew out money before some age ( I forget what the age is cause they keep changing the damn number).
Anyway my attorney is GREAT!! He specializes in representing women. Now, anyone ( including my H) can contest anything in court but it sure makes it difficult for them. …
Loose that “mediator” type and get you a good one that grasps that these guys are dangerous….
November 28, 2013 at 12:07 am #118166beenthereParticipantThanks. I’m in CA, and they are done, but usually to rectify a pre nup boo boo or separate community property assets from depredations from gamblers, etc.
Appreciate the candor, I’m sure my atty wants to make this unassailable by a judge, but I don’t like feeling like the creepy one for standing up for restorative justice!!!

I came out with a pretty good deal.
