Teri, we are in the same state and the answer is YES YOU CAN! It’s a community property state and it makes no difference if your name is on it or not. My name isn’t on my h veh and I put one on it. It’s still in there too.
Depending on the tracker you use, you may need keys to access the veh to have it installed. I have spares and mine was a full on take apart the dash to install tracker which requires the keys afterward to make sure everything was hooked up correctly.
The question you need to ask an atty is this- if yall have filed for divorce, does the paperwork include temp orders or anything saying what you have currently is yours and what he has is his? If so, that could POSSIBLY include vehs so check that out first. Married or just living together, it’s considered both of yours even if you have never driven it before.
That’s the beauty of our state law- there’s lots of wiggle room.
